Have you any reasons why you cannot accept the cash book, except prejudice?.

Yes, items have gone through the cash book, which to my mind, are not cash.

Are you referring to the items of the Statutory Balance, which is the purport of this charge?. Yes, to them.

To any other item?.

Your Compradore paid $45,000.00 in cash on the 30th

I can hardly believe that he paid cash $45,000.00.

45,000.00 I do not know whether he did

of not.

You say you will not believe our cash books because it has these items, because you dislike the way it is done?.

Yes.

Is there anything in these transactions in the cash books which you don't like, which is antagon- istic to the explanations given in the Public Exam- ination?.

No.

And you are satisfied that those entries in the books are not inconsistent with the statement?. The cash book is consistent with the explanation given.

Is consistent?.

Yes.

I am going to put it to you that the correct defini- tion of cash is coin or the right to command coin" would you accept that as a sound definition of cash? I do not think I am in a position to define cash. In your opinion is that a fair definition of cash?.

His Lordships

That is a matter for the jury.

You say that $761,100.00 were reduced in about 12?)

months time to $349,000.00 or something about half. How was it done?

The chief item was the repayment of the loan of $432,000.00 by Mrs. Brewer.

So that apart from that No432,000.00 how much would it have been reduced by? Can you give me that?. Ma*x*xatunxkagkrackinxxxx

No, I cannot give it you.

Do you know who reduced that loan besides the $432,000.00 which nearly accounts for the whole?. No, I cannot tell you.

You say you cannot name anyone who reduced their loan?.

No, I cannot tell you unless I go through the books. I am dealing with two different dates and did not anticipate that you would ask me these together. At the time of the Balance Sheet I divided these loans up and some are under the heading of Promissory Notes and others are under the heading of Collater

CRXEX 1 Security Loans.

Did this repayment go through the cash book?. No, my Lord, it went through the Journal.

It did not go through the cash book at all it is merely the reverse of a different entry?.

The loan was repaid according to the Journal by

cash but cash did not go through the cash book as it should have done.
